"To establish freedom, peace and justice in a society, the rule of law is of paramount importance. Currently, there is no rule of law in Burma. In every country, having produced a constitution, the government itself is to obey it. The declaration of rules, laws and orders, which are contrary to the constitution, should
be prohibited. For instance, Chapter 11 of the 1974 Constitution of the Union of Socialist Republic of Burma recognizes ?The fundamental rights and duties of the citizens”. Furthermore, it is enshrined in section 159 (A) of this chapter that ?The personal liberty and security of every citizen shall be guaranteed,” and in
section (159) (B) that ?Without the permission of the relevant judiciary, a citizen should not be kept in custody for more than 24 hours”. In reality, officials appointed by the Burmese Socialist Program Party (BSPP) can arrest and extend the detention periods of suspected persons at any time without sound proof. This case clearly demonstrates violations of the constitution and the absence of rule of law..."
