Committee Representing Pyidaungsu Hluttaw - Declaration No. 3/2021

Description:

"1. According to the constitutional principle that the Sovereign power of the Union is derived from the citizens and is in force in the entire country, in a time when the Union's sovereign power is being held forcibly by an armed group, the non-violent Civil Disobedience Movement (CDM) against the unlawful military coup group by the people (including the civil servants), who are original owners of the Union's sovereign power, is “lawful", and regarded as a lawful movement to protect the citizen rights. 2. Due to the fact that the coup, breaching and violating the Constitution, is totally unjustifiable by any stipulation described in Chapter (11) Provisions on State of Emergency, the Committee Representing Pyidaungsu Hluttaw has declared that any body to organization, or group formed by the coup must be deemed unconstitutional, and thus illegal. 3. The unlawful group, that took power via coup, cannot practice legislative, judiciary and executive power of the State. 4. Laws, orders and ordinances to the civil servants from the unlawful military coup group are "illegal" and "illegitimate" and therefore has "no binding legal power to accept and obey by the civil servants. Thus, the public does not need to follow any of these laws, orders and ordinances. 5. "Civil Disobedience Movement (CDM)" is the movement against the military dictatorship, which is a movement for our nation, could not be regarded as “party politics" and has no conflict with article 26 clause A of the 2008 Constitution. 6. Therefore, we insist all civil servants to join “Civil Disobedience Movement (CDM)" against the military dictatorship, and Committee Representing Pyidaungsu Hluttaw (CRPH) guarantee the civil servants that their original positions, roles and responsibilities will be fully protected by legislation from the Pyidaungsu Hluttaw. Committee Representing Pyidaungsu Hluttaw..."
