National Convention Delegates Groups' Meetings Commence
YANGON, 9 Dec — The delegate groups of political parties, representatives-elect, workers, intellectual and intelligentsia, State service personnel and other invited persons held their meetings at the designated halls of Nyaunghnapin Camp in Hmawby Township this morning.
The meetings were attended by members of panel of chairmen from respective delegate groups.
Delegate group of political parties
The delegate group of political parties held its meeting at the meeting hall-1 at 9 am today.
During the meeting, alternate chairman was U Saw Philip (a) U Philip Sam from Wa National Development Party while Deputy Director of the working group-3 under the National Convention U Khin Maung Phyu acted as master of ceremonies and Assistant Director U Khin Sein, co-master of ceremonies.
First, the master of ceremonies announced the start of the meeting with the permission of the meeting chairman as 27 out of 28 delegates were present, accounting for 96.43 per cent.
Next, Alternate Chairman U Philip Sam (a) U Saw Philip from Wa National Development Party made an opening speech on the occasion.
Panel of Chairmen's compilation in respect of the proposals of delegates group of political parties regarding the detailed basic principles to be laid down for sharing of executive and judicial powers to be included in the writing of the State Constitution was read by U Tun Yi of National Unity Party, U Yan Kyint Kan of Kokang Democracy and Unity Party, U Nyi Pa Loat of Wa National Development Party and U Aung Khin of Union Pa-O National Organization.
After the concluding remarks had been made by the alternate chairman, the meeting adjourned at 10.48 am.
Delegate group of representatives-elect
The delegate group of representatives-elect held its meeting at the hall-2 at 9 am today.
During the meeting, U San Tha Aung of Mro (a) Khami National Solidarity Organization was an alternate chairman and U Yaw Aye Hla of Lahu National Development Party and U Maung Gyi of Union Pa-O National Organization, members of the panel of chairmen while Deputy Director of the working group-4 under the National Convention U Maung Maung Phyu Tint acted as master of ceremonies and Assistant Director Daw Mie Mie Shein, co-master of ceremonies.
First, the master of ceremonies announced the start of the meeting with the permission of the meeting chairman as all 13 delegates were present, accounting for 100 per cent.
Next, Alternate Chairman U San Tha Aung from Mro(a) Khami National Solidarity Organi-zatin delivered an opening address on the occasion.

The delegate group of workers held its meeting at the meeting hall-5 at 9 am today.
During the meeting, U Kyaw Win Tun of Mandalay Division was an alternate chairman and U Kyaw Myo Win of Bago Division and U Bo Thein of Shan State (East), members of panel of chairmen while Deputy Director of the working group-7 under the National Convention U Zaw Win acted as master of ceremonies and Assistant Director U Aung Win, co-master of ceremonies.
First, the master of ceremonies announced the start of the meeting with the permission of the meeting chairman as all 47 delegates were present, accounting for cent per cent.
Next, Alternate Chairman U Kyaw Win Tun of Mandalay Division made an opening speech on the occasion.

The delegate group of intellectuals and intelligentsia held its meeting at the meeting hall-6 at 9 am today.
During the meeting, Head of Office of the Ministry of Rail Transportation U Hla Myint was alternate chairman and Film Director U Khin Zaw and Chairman of Myanmar Academy of Agriculture, Forestry and Livestock Breeding U Tin Hlaing, members of panel of chairmen while Deputy Director of the working group-8 under the National Convention U Than Win acted as master of ceremonies and Assistant Director U Nyein Myint co-master of ceremonies.
First, the master of ceremonies announced the start of the meeting with the permission of the meeting chairman as 53 out of 56 delegates were present, accounting for 94.64 per cent.
Next, Alternate Chairman U Hla Myint of Head Office of the Ministry of Rail Transportation made an opening speech on the occasion.

The delegate group of State service personnel held its meeting at the meeting hall-7 at 9 am today.
During the meeting, U Hla Tin of the Ministry of Commerce was the alternate chairman and U Arnt Maung of the Ministry of Religious Affairs and U Myat Ko Ko of the Ministry of Home Affairs, members of panel of chairmen while Deputy Director of the working group-7 under the National Convention U Htay Win acted as master of ceremonies and Assistant Director U Htein Min, co-master of ceremonies.
First, the master of ceremonies announced the start of the meeting with the permission of the meeting chairman as 108 out of 109 delegates were present, accounting for 99.08 per cent.
Next, Alternate Chairman U Hla Tin of the Ministry of Commerce made an opening speech on the occasion.

10 points clarified by the NCCWC Chairman in connection with the executive power of the region or state government and duties and rights of the executive power should be laid down as detailed basic principles
YANGON, 8 Dec — The following is a translation of the clarification made by member of the Panel of Chairmen U Law Hsin Kwan on collections of the proposal papers submitted by the National Convention delegate groups for laying down detailed basic principles for sharing of executive and judicial powers to be included in the State Constitution at Nyaunghnapin Camp in Hmawby Township yesterday.
The delegate group of national races supported the clarification of National Convention Convening Work Committee related to the executive power of the region or the state government.
According to the detailed basic principles, the Union Government will finance the regions and state governments with regard to financial matters. The regions and state governments should also finance the budget of the Union Government if their budgets are in surplus. In 1992-1993 financial year, the amount of money spent is greater than money earned in the financial year in most of the states and divisions. In the very financial year, Taninthayi Division earned K 361.37 million and spent K 213.33 million. That’s why, the division contributed K 148.04 million to the budget of the Union. Hence, if the budgets of the regions and states are in surplus in the future, they should make reasonable contributions to the budget of the Union Government.
The delegate group of peasants suggested that the 10 points in connection with executive power of the region or state government presented by the Chairman of the National Convention Convening Work Committee should be laid down as detailed basic principles of the State Constitution.
The delegate group of workers also suggested that the 10 points clarified by the NCCWC Chairman in connection with the executive power of the region or state government and duties and rights of the executive power should be laid down as detailed basic principles.
The delegate group of intellectuals and intelligentsia discussed that the 10 points clarified by the Chairman of the Work Committee in connection with the executive power of the region or state government and duties and rights of the executive power were proper for the State Constitution.
The delegate group of the State service personnel suggested that the 10 points clarified by the Chairman of the Work Committee in connection with the executive power of the region or state government should be laid down as the detailed basic principles.
The delegate group of the other invited delegates also presented that the 10 points clarified by the Chairman of the Work Committee in connection with the executive power of the region or state government were complete and, therefore, they should be laid down as the detailed basic principles.
Executive power of the self-administered division and self-administered zone appropriate and reasonable
YANGON, 8 Dec — The following is a translation of the clarification made by member of the Panel of Chairmen Duwa Zoat Dong on collections of the proposal papers submitted by the delegate groups on laying down detailed basic principles for sharing of executive and judicial powers to be included in the drawing of the State Constitution at the National Convention held at the Nyaunghnapin Camp, Hmawby Township, yesterday.
The Chairman of the National Convention Convening Work Committee at the Plenary Session of the National Convention held on 8 March 2005 said that I will now present the study on the allocation and delegation of the executive power to the self-administered division and self-administered zone leading bodies and the related authority and duties.
According to the already-laid-down detailed basic principles, the self-administered division and the self-administered zones have been designated as follows:
(a) Naga Self-Administered Zone (Sagaing Division);
(b) Danu Self-Administered Zone (Shan State);
(c) Pa-O Self-Administered Zone (Shan State);
(d) Palaung Self-Administered Zone (Shan State);
(e) Kokang Self-Administered Zone (Shan State);
(f) Wa Self-Administered Division (Shan State);
The detailed basic principles — as the self-administered division and the self-administered zones are self-administered areas they are of equal status — the self-administered division leading body is formed in the self-administered division, and the self-administered zone leading bodies are formed in the self-administered zones — have already been laid down.
As regards the delegation of legislative power to the self-administered areas, a detailed basic principle — legislative power prescribed by the Constitution is distributed to self-administered areas — has been laid down, and in connection with the distribution of executive power, a detailed basic principle — executive power prescribed by the Constitution is distributed to self-administered areas — has been laid down. Thus, the self-administered division leading body and the self-administered zone leading bodies will have the right to exercise the legislative power and the self-administrative power prescribed by the Constitution.
The Chairman of NCC Work Committee continued to say that the following are a collection of points concerning the executive power of the self-administered division and self-administered zone leading bodies and the rights and duties related to the power that should be laid down as detailed basic principles:
1. Subject to provisions of the Constitution, the self-administrative power of the self-administered division and self-administered zone leading bodies extends to the following matters:
(a) with respect to which the self-administered division and self-administered zone leading bodies has power to make laws;
(b) with respect to which the self-administered division and self-administered zone leading body has power to make laws in accord with any law enacted by the Pyidaungsu Hluttaw; and
(c) with respect to which the self-administered division and self-administered zone leading body has power to make laws in accord with any law enacted by the respective region or state hluttaws.
2. Self-administered division or self-administered zone leading body has the duty to help the Union Government in its drive to ensure stability of the State, community peace and tranquillity and the rule of law.
3. The self-administered division or the self-administered zone leading bodies shall
(a) subject to the policies of the Union Government, draw work programmes for development of their territory and shall coordinate the matter with the respective region government or state government;
(b) draw annual budgets and coordinate with the region or state government concerned in accord with the provisions of the Constitution for approval;
(c) have the right to use the allotted budget funds included in the budget law of the region or state concerned;
(d) use the fund of the current expenditure permitted within the last-enacted budget law of the hluttaw of the region or state concerned if they cannot obtain the budget allotment in time due to region or state hluttaws failure to enact the budget law in time.
4. Self-administered division and self-administered zone leading bodies shall, in accord with the law, supervise and coordinate the functions of civil service organizations discharging duties in their territory.
5. The self-administered division and self-administered zone leading bodies shall submit reports stating the general situation of the territory to the Union Government and the region or state government concerned.
6. The self-administered division and self-administered zone leading bodies shall carry out the task assigned occasionally to them by the Union Government and the region or state government concerned.
With regard to the clarification, National Unity Party discussed that the Chairman of NCC Work Committee presented six points concerning executive power of the self-administered division and self-administered zone leading bodies.
Self-administered areas leading bodies are to coordinate and cooperate with government of respective region or state and Union Government for carrying out tasks of economic, social, education, health, development affairs and transport sectors of their regions. In connection with the distribution of executive power, a detailed basic principle — executive power prescribed by the Constitution is distributed to self-administered areas — has been laid down. Therefore, executive power of the self-administered division and self-administered zone leading bodies in conformity with the above-mentioned principles are appropriate and reasonable.
Union Pa-O National Organization made discussions that self-administered division and self-administered zone leading bodies are to lead performing of administration tasks in their respective regions. Executive power of the self-administered division and self-administered zone leading bodies, and the rights and duties related to the power from No 1 to No 6 points concerning contribution to peace and stability and prevalence of law and order, collection of tax, drawing of long- and short-term plans and budget bill, supervision to employees, compilation and submitting of reports, and discharging the assigned duties conscientiously should be laid down as detailed basic principles.
In addition, a separate suggestion was submitted that in connection with the distribution of executive power, a detailed basic principle — executive power prescribed by the Constitution is distributed to self-administered areas — has been laid down. Hence, the principles had been laid down to enable the self-administered division and the self-administered zone leading bodies to have the authority concerning urban and rural projects, construction and maintenance of roads and bridges, public health, development affairs, taking of fire preventive measure, preservation of pasture land, safeguarding and preservation of forest, environmental conservation in conformity with the law enacted by the Union, matters related to power and water supply in urban and rural areas, and markets affairs in urban and rural areas. However, the education sector was absent from the section. Therefore, it is necessary to add the education task to the section.
Mro (or) Khami National Solidarity Organization discussed their observation related to the clarification on six points concerning executive power of the self-administrative power of the self-administered division and the self-administered zone leading bodies. As the clarification is reasonable, these points should be adopted as detailed basic principles.
The self-administered division or self-administered zone leading bodies shall carry out the tasks assigned occasionally to them by the Union Government and region or state government
YANGON, 8 Dec — The following is is a translation of the clarifications made by member of Panel of Chairmen U Kyi Tint on collections of the proposal papers submitted by the National Convention delegate groups for laying down detailed basic principles for sharing of executive and judicial powers to be included in the State Constitution at Nyaunghnapin Camp in Hmawby Township yesterday.
Delegates of Lahu National Development Party reported that the following detailed basic principles are proper. Subject to provisions of the Constitution, the self-administrative power of the self-administered division and self-administered zone leading bodies extends to the following matters:
(a) with respect to which the self-administered division and self-administered zone leading bodies has power to make laws;
(b) with respect to which the division and self-administered zone leading body has power to make laws in accord with any law enacted by the Pyidaungsu Hluttaw; and
(c) with respect to which the self-administered division and self-administered zone leading body has power to make laws in accord with any law enacted by the respective region or state hluttaws.
“Self-administered division and self-administered zone leading body has the duty to help the Union Government in its drive to ensure stability of the State, community peace and tranquillity and the rule of law.” Helping the Union Government contributes towards stability, the rule of law and community peace and tranquillity of the respective region or state and the entire nation.
Therefore, the following basic principles are appropriate.
“Self-administered division or self-administered zone leading body has the duty to help the Union Government in its drive to ensure stability of the State, community peace and tranquillity and the rule of law.”
Chairman of the National Convention Convening Commission made detailed clarifications on matters relating to Self-administered division and self-administered zone leading bodies for laying down the detailed basic principles. Laying down the detailed basic principles of the para 3, section (a) to (d) in the clarifcations was suitable.
The self-administered division and self-administered zone leading bodies are to supervise, inspect, guide, coordinate and cope with the functions of civil service personnel in the areas. Therefore,Self-administered division and self-administered zone leading bodies shall, in accord with the law, supervise and coordinate the functions of civil service organizations discharging duties in their territory.
The detailed basic principles were proper.
Self-administered division and self-administered zone leading bodies should have the right to duly inform the Union Government and the region or state government concerned about the prevailing situation of their territories, and the requirements and assistance. Therefore the following should be laid down as the detailed basic principles.
“The self-administered division or self-administered zone leading body shall submit reports stating the general situation of the territory to the Union Government and the region or state government.”
The self-administered division or self-administered zone leading bodies are to carry out the tasks assigned to them by the Union Government and the region of state government concerned. Therefore the following basic principle was proper.
“The self-administered division or self-administered zone leading bodies shall carry out the tasks assigned occasionally to them by the Union Government and region or state government concerned.”
The delegates of Union Kayin League reported that the six points regarding the executive power of the self-administered division or self-administered zone leading bodies clarified by Chairman of the National Convention Convening Commission should be laid down as detailed basic principles.
The delegates of Kokang Democracy and Unity Party reported that according to the already-laid down basic principles, the self-administered areas designated at the National Convention. According to the constitution, the self-administered areas are vested with the legislative power. The self-administered areas are vested with executive power in according to the constitution.
The distribution of legislative and executive powers to the self-administered areas is proper according to the constitution and the policies of the State. According to the constitution, the self-administered division or self-administered zone leading bodies in the self-administered areas have rights to exercise designated legislative and executive powers in the areas so that the regions will develop in all sectors.
The findings of the Work Committee in connection with the executive power of the self-administered division or self-administered zone leading bodies were appropriate.
The delegates of Wa National Development Party reported that the points from 1 to 6 of the Work Committee regarding the executive power and duties of the self-administered division or self-administered zone leading bodies should be laid down as the detailed basic principles.
The representatives-elect delegates, one of the eight National Convention delegates, submitted four proposals. Political parties discussed the attitudes of the National Unity Party and Mro (or) Khami National Solidarity Organization.
Dr Hmu Thang, independent representative-elect of Thantlang Township constituency of Chin State, independent representative-elect U Aung Thein of Ywangan Township constituency of Shan State, independent representative-elect U Tun Kyaw of Namhsan Township constituency of Shan State (North) supported the clarifications by the chairman of NCCWC on executive powers of the self-administered division or self-administered zone leading bodies.
The member of the Panel of Chairmen said he would like to discuss the duties to be assigned by the Union Government and region or state government to the self-administered division or self-administered zone leading bodies. On 8 March 2005, Chairman of the Work Committee clarified the related matter at the National Convention Plenary Meeting.
The self-administered division or self-administered zone leading bodies shall carry out the tasks assigned occasionally to them by the Union Government and region or state government. In connection with this, he would like to make some suggestions. He considered that the term “region or state government” covers not only the respective region or state governments but also other region or state governments for the self-administered division or self-administered zone leading bodies. Therefore, the expression, “region or state government concerned” should be used instead of “region or state government.”
Three delegates including Dr Hmu Thang made suggestions on that. The following detailed basic principle should be laid down.
“The self-administered division or self-administered zone leading bodies shall carry out the tasks assigned occasionally to them by the Union Government and region or state government concerned.”
U Tin Win, independent representative-elect of Kyaiklat Township constituency-2 independent representative-elect U Thein Kyi of Taungdwingyi Township constituency -1, independent representative-elect U Hla Soe of Minbu Township constituency-2, independent representative-elect U Mya Hlaing of Twantay Township constituency -2, U Kyi Win of Mingaladon Township constituency-1 and U Tin Tun Maung of Mingaladon Township constituency-2 reported that the clarifications of the Chairman of Work Committee regarding executive power of the self-administered division or self-administered zone leading bodies were genuine requirements for the State and proper. They should be laid down as the detailed basic principles.
The delegates of national races also reported that the six points regarding the executive power of the self-administered division or self-administered zone leading bodies by the Chairman of Work Committee should be laid down as the detailed basic principles.
The delegates of peasants also reported that the six points regarding the executive power of the self-administered division or self-administered zone leading bodies by the Chairman of Work Committee should be laid down as the detailed basic principles.
The delegate group of workers discussed that the six points regarding the executive powers of self-administered division and self-administered zone leading bodies clarified by the Chairman of the NCC Work Committee should be laid down as detailed basic principles.
The delegate group of intellectuals and intelligentsia disclosed that they studied and assessed in detail what have been presented by the NCC Work Committee and concluded that executive powers, duties and functions of self-administered division and self-administered zone leading bodies are proper and appropriate.
They also discussed that powers and duties and functions to be vested in self-administered division and self-administered zone leading bodies should be laid down as detailed basic principles.
The delagate group of State service personnel that the six points regarding the executive powers of self-administered division and self-administered zone leading bodies clarified by the Chairman of the NCC Work Committee should be laid down as detailed basic principles.
Other invited persons delegate group discussed that the six points regarding the executive powers of self-administered division and self-administered zone leading bodies clarified by Chairman of the NCC Work Committee U Aung Toe should be laid down as detailed basic principles.
At the plenary meeting of the National Convention held on 8 March 2005, the Chairman of the NCC Work Committee clarified that he would present what the Work Committee has found in connection with the adoption of detailed basic principles for State service personnel.
As reagrds the occupational guarantee for State service personnel, neither 1947 Constitution nor 1974 Constitution embodied precise provisions.
Therefore, the National Convention has laid down basic principles for State service personnel as follows:
(1) State service personnel shall be free from party politics.
(2) The State shall enact necessary laws for State service personnel to have due security in service and sufficiency of food, clothing and shelter, for married women in service to get maternity benefits, and for welfare to ease livelihood of persons who have retired from service.
The post-independence Constitutions do not mention precisely the matters related to the occuptaional security for State service personnel. Therefore, the delegates to the National Convention should lay down appropriate detailed basic principles concerning the occupational security and welfare.
In connection with the State service personnel, it is therefore necessary to discuss and suggest as to whether or not detailed basic principles should be adopted as follows:
(1) State service personnel shall be free from party politics.
(2) Matterts as to the appointment of employees, promotion, retirement, the enforcement of rules, the designation of service rules, and taking action against service personnel in accord with law.
(3) As to occupational security for State service personnel; the sufficiency of food, clothing and shelter needs; maternal rights for married women service personnel; and the provision of food, clothing and shelter needs and shelter assistance to the retired, necessary laws shall be enacted.
(4) Given the unusual nature of the responsibility of the Tatmadaw members, who are State service personnel, they shell be dealt with according to military law.
(5) Given the unusual nature of the responsibility of Myanmar Police Force members, who are State service personnel, separate laws shall be promulgated for them.
With regard to the clarifications of the Chairman of the NCC Work Committee, the National Unity Party discussed that in exercise of the duties and functions vested by the State, State service personnel are serving the interest of the State and the people. The laying down of detailed basic principles is proper for State service personnel to designate the duties required, approve the rules to be observed, take action against those who violate rules and regalations.
As duties and functions have been designated for State service personnel, taking steps for them to enjoy the rights of having occupational security and sufficiency of food, clothing and shelter needs is proper. Therefore, are points regarding State service personnel presented by the Chairman of the NCC Work Committee are appropriate.
Their other suggestions are:
Of 104 detailed basic principles laid down by the National Convention, basic principles concerning State service personnel have been stated under the separate title. Therefore, detailed basic principles regarding State service personnel should be put under the title concerned instead of the executive power.
Concerning the fact that State service personnel shall be free from party politics, they said they would like to suggest a little. Of the six objectives of the National Convention, the fourth objective is to ensure flourishing of a genuine multiparty democracy. Moreover, according to multiparty democracy system, the political parties will surely be in existence in the country as efforts are being made for the emergence of a modern and developed nation. The political parties representing their parties concerned stand for the elections at different levels and are to be chosen. In this regard, voters including State service need to properly choose parties and persons capable of serving the interest of the State and the people. To be able to do so, the voters need to clearly know policies and attitudes of those parties and persons.
However, some do not properly know the fact that State service personnel shall be free from party politics. Generally, the point calling for Service personnel to be free from party politics has been just stipulated for them in order not to misuse the duties and functions vested by the State in the interest of the parties they like. So, to clearly understand this, the objectives of the fact should be extensively defined.

Union Kayin League discussed that State service personnel are
specially needed to be dutiful, upright and free from sectarian. In
the multi-party democracy system, State service personnel should
remain robust regardless of any government change so that the State
machinery at different levels can run smoothly. Therefore, the five
