Description: " The Governing Body of the International Labour Organization (ILO) has decided to establish a Commission of Inquiry in respect of the non-observance of International Labour Standards in Myanmar, following the military coup in February 2021. The Commission of Inquiry will investigate the non-observance of the Freedom of Association and Protection of the Right to Organise Convention, 1948 (No. 87) and the Forced Labour Convention, 1930 (No. 29) . The resolution adopted by the Governing Body noted with profound concern “the escalation of large-scale lethal violence against civilians, including children, and the arrest and torture of Aung Ko Latt, a member of the Mahlwagone Railway Union,” and called on the military to end such action immediately. It also deplored the “continued harassment, intimidation and arbitrary arrests and detentions of labour activists, trade unionists and others, including the Rohingya, in the exercise of their human rights.” Myanmar should ensure that workers’ and employers’ organizations are able to exercise their rights in a climate of freedom and security, free from violence, arbitrary arrest and detention, the resolution says. A Commission of Inquiry is the ILO’s highest-level investigative procedure and is generally set up when a Member State is accused of committing persistent and serious violations and has repeatedly refused to address them. To date, 14 Commissions of Inquiry have been established. Consisting of three independent members, who are yet to be appointed, the Commission of Inquiry will be responsible for carrying out a full investigation of the complaint, ascertaining all the facts of the case and making recommendations on measures to be taken to address the problems raised by the complaint..."

The Governing Body notes that while progress has been made, a number of fundamental activities required under the Action Plan for the Elimination of Forced Labour in Myanmar by 2015 have not yet been implemented. The text of this Agreement for Extension is reproduced in Appendix I..... 2. In paragraph 27 of document GB.313/INS/6, the Office announced the signature of a Memorandum of Understanding regarding the development of a comprehensive, joint and benchmarked strategy for the elimination of all forms of forced labour in Myanmar by 2015. The Memorandum of Understanding was signed by both the ILO and the Government of Myanmar on 16 March 2012. Its text is reproduced in Appendix II.

Description: "...109. The Committee takes note of the information provided by the Government. As regards its recommendations of a legislative nature, the Committee recalls that for a number of years it has emphasized the need to both elaborate legislation guaranteeing freedom of association and ensure that existing legislation which impedes freedom of association would not be applied. It also recalls that the persistent failure to take any measures to remedy the legislative situation constitutes a serious and ongoing breach by the Government of its obligations flowing from its voluntary ratification of Convention No. 87. In light of these principles, the Committee welcomes the information provided by the Government that the Parliament will take the necessary measures regarding the repealing of Orders Nos 2/88, 6/88, the Unlawful Association Act and Declaration No. 1/2006...113. The Committee takes note of the information provided by the Government and in particular, once again, the information concerning its intention to draft new legislation in conformity with Convention No. 87. The Committee, however, once again deeply regrets that the Government‟s communications essentially repeat those previously submitted, while failing to provide any new concrete information or present any evidence that it has taken concrete measures in respect of the serious matters presented in this case. It therefore deplores that the Government has failed to implement its recommendations and finds itself obliged to refer to its previous examination of this case and to firmly urge the Government to fully implement as a matter of urgency its previous recommendations. The Committee requests the Government, in particular, to provide specific and detailed information on the situation of Thurein Aung, Wai Lin, Nyi Nyi Zaw, Kyaw Kyaw, Kyaw Win and Myo Min. It requests the Government to take all the necessary measures to ensure their immediate release, as well as their access to legal and medical assistance while detained. Finally, the Committee urges the Government to immediately undertake real and concrete steps to ensure full respect for freedom of association in law and in practice..."

Concluding remarks: "As noted in the beginning of this report, the conclusions of the Governing Body mandated the Office to undertake a full review of the operation of the Supplementary Understanding and make recommendations for its future and the ILO?s ongoing role in Myanmar. On the basis of what has been covered in this report, the following remarks would seem warranted. 28. The Office trusts that the Governing Body appreciates the circumstances in which the extension of the trial period of the Supplementary Understanding appeared to be the most viable solution. It is too early to make a definitive pronouncement on the mechanism, given the various questions which have been underlined by the developments recorded by the Liaison Officer and the discussions that the ILO mission held in Nay Pyi Taw and Yangon from 25 to 28 February 2008. Concrete measures are expected on the follow-up of specific cases, on translations and distribution of information material, educational activities and the ways to reach better the population in the country. 29. Forced labour in Myanmar continues to be a serious problem. While a mechanism such as the one introduced by the Supplementary Understanding will not be able on its own to have a major impact on the problem, it demonstrates how, given political will and the necessary legal and administrative safeguards, it can make a difference. 30. In this respect, whatever the shortcomings as regards the content and process for the adoption of a new Constitution, it has the potential of providing the authorities with an opportunity to bring legal clarity to the prohibition of forced labour. Although the Government has not yet made a high-level public statement of the kind that the Governing Body has called for in November 2007, following up a possible future constitutional commitment vigorously, genuinely and transparently would be a significant and concrete expression of the commitment of the authorities to abandoning the still prevalent use of forced labour throughout the country."

Description: "...The Governing Body considered all of the information before it including the comments and information provided by the Permanent Representative of Myanmar. It noted the progress reported in the operation of the Supplementary Understanding (SU) up to the time of public demonstrations and their suppression at the end of September 2007, including the educational activity that had been jointly undertaken by the Ministry of Labour and the ILO. 2. The Governing Body, however, expressed its serious concern at the Government's crackdown in response to the recent peaceful protests. In this respect, it noted with deep regret the imprisonment of persons exercising their fundamental right to freedom of association and the freedom of expression it entails, and called on the Government to comply fully with its responsibilities in accordance with Convention No. 87, which it has ratified. The long prison sentences given on 7 September 2007 to six activists should be reviewed and the persons concerned released. The Governing Body also noted with concern the detention of persons associated with the facilitation of forced labour complaints under the SU. This clearly contradicted the sense of the SU and the Governing Body called on the Government to immediately release those persons, in particular Daw Su Su Nway and U Min Aung..."

Description: "...There is a continuing trend of constructive engagement in Myanmar's relations with the ILO since the 95th Session of the International Labour Conference of June 2006. All three pending cases involving Su Su Nway, Aye Myint and the Aung Lan case have been resolved as requested by the International Labour Conference. A moratorium of six months which was announced by Myanmar in June 2006 on a trial basis for not taking action against false complaints of forced labour was extended in December last year, pending the establishment of a mechanism to address cases of forced labour. Description: The ILO Governing Body today reactivated the ?measures” contained in the International Labour Conference (ILC) resolution of June 2000. In fact, as the Conclusions of today?s meeting state, the measures have never ceased to be in force. The ?reactivation” consisted in affirming that no adequate moves have been taken by the Burmese military regime (the ?Government” of Myanmar) to reduce forced labour in Burma/Myanmar, and that there is therefore no reason not to apply the ?review of relations” requested in the 2000 resolution. The ILO press release (Document 1, below) helps to clarify the Conclusions, Document 2, and the ILC 2000 resolution (Document 3) sets out the ?measures”. Document 4 consists of links to the ILO reports submitted to the March 2005 session of the Governing Body, its Conclusions, and the ILO section of the Online Burma/Myanmar Library.

Description: The report describes the interaction of the Liaison Officer ad interim (LOAI) with the authorities, including the Convention 29 Implementation Committee. Regarding the 38 cases referred tothe Committee by the LOAI, "In all these cases,the allegation that forced labour was involved was rejected. In the six cases where individuals complained directly to the court, three cases were rejected on the grounds that there was no prima facie evidence of forced labour, and in three cases the trials are still ongoing. More disturbingly, in two of the cases that were rejected, the complainants were prosecuted for defamation and imprisoned for six months each...". It examines developments in the high treason case and of the forced labour situation, of which it states: "...On the basis of all the information available to him, the Liaison Officer a.i.?s general evaluation of the forced labour situation continues to be, as presented previously to the Governing Body, 8 that although there have been some improvements since the Commission of Inquiry, the practice remains widespread throughout the country, and is particularly serious in border areas where there is a large presence of the army...".

Report of the ILO technical cooperation mission to Myanmar (Friday, 20 October-Thursday, 26 October 2000). 1. Origin of the mission. 1. In talks with the Permanent Representative of Myanmar, Ambassador U Mya Than, shortly after the conclusion of the 88th Session of the International Labour Conference, the Director-General emphasized the need for urgent action on the part of the Myanmar authorities to give effect as quickly as possible to the resolution adopted by the Conference at its 88th Session. He recalled that the resolution in question had authorized the Office to respond positively to all requests by Myanmar for assistance in attaining that goal. On 14 July, the Director-General followed up this conversation with a letter addressed to the Minister of Labour of Myanmar (Annex 1). 2. In an interim reply dated 7 August (Annex 2), the Minister of Labour, while expressing regret that the Conference had not chosen the path of cooperation to resolve the issue, stated that consultations were in progress in Yangon with a view to the adoption of a considered position. 3. On 8 September, the Director-General met the Minister of Foreign Affairs of Myanmar, Mr. Win Aung, at the United Nations Millennium Summit. During the meeting, the Director-General again emphasized the increasing urgency of action on the part of the Myanmar authorities to give effect to the Conference resolution, given that the next session of the Governing Body was only two months away, and recalled that such action was needed in the three main areas indicated in the resolution, namely legislative, executive and administrative measures. In the absence of any concrete action in those areas, the measures adopted by the Conference would take effect. The Minister assured the Director-General..."

In paragraph 40 of its report, the mission indicated that following the announcement made by Secretary-1, new elements in the form of a document issued by the SPDC itself would probably be made available. 2. The Director-General on Friday, 3 November received a letter from the Minister of Labour which communicated the text of an instruction signed by Lieutenant-General Khin Nyunt in his capacity as Secretary-1 of the SPDC. In addition, in a separate communication addressed to the head of the mission, the Director-General of the Department of Labour specifies the measures adopted to ensure that forced labour is no longer imposed in practice. These communications are attached (Annexes A and B). 3. The following observations may assist the Governing Body in its assessment of the import of these new elements: (i) The chain of command in Myanmar 4. The highest authority in Myanmar is the State Peace and Development Council (SPDC), which includes all military regional commanders and the chiefs of staff of the army, navy and air force, but does not include government ministers. Description: 279th Session Review of the scope of the resolution. Follow-up to the resolution adopted by the International Labour Conference at its 88th Session (May-June 2000). Review of the scope of the resolution 1. Under the terms of article 33 of the Constitution of the ILO, the International Labour Conference adopted a resolution approving the measures recommended by the Governing Body at its 277th Session (March 2000) to secure compliance with the recommendations of the Commission of Inquiry established to examine the observance by Myanmar of its obligations in respect of the Forced Labour Convention, 1930 (No. 29), and decided that those measures would take effect on 30 November 2000, subject to the conditions set out in paragraph 2 of the resolution. The Conference considered that it could not abstain from the immediate application of the measures recommended by the Governing Body ?unless the Myanmar authorities promptly take concrete action to adopt the necessary framework for implementing the Commission of Inquiry?s recommendations, thereby ensuring that the situation [of workers affected by various forms of forced or compulsory labour] will be remedied more expeditiously and under more satisfactory conditions for all concerned?. 1 2. The Conference entrusted the Governing Body with the task of examining the legislative, executive and administrative framework which must be ?sufficiently concrete and detailed to demonstrate that the recommendations of the Commission of Inquiry have been fulfilled? and such as to give effect to the intentions expressed by the Minister of Labour of Myanmar in his letter dated 27 May 2000, which followed the first technical cooperation mission sent by the Director-General to Yangon from 23 to 27 May 2000.
