Joint Demands of the Aust Govt, Indon, and the UN.doc

DEMANDS OF THE AUSTRALIAN GOVERNMENT

1.      That in accordance with General Assembly resolutions 1514
(XV), 1541(XV), 2625(XXV) and the relevant resolutions and decisions
adopted by the Security Council and the General Assembly on the question of 
East Timor, Australia cease to recognise Indonesia's sovereignty over East
Timor;

2.      That as Article 3 of the Agreement Between the Republic of
Indonesia and the Portugese Republic on the Question of East Timor, which
gave Indonesia responsibility for peace and security in East Timor, has 
been
breached, Australia should demand that peacekeeping forces are sent to East 
Timor immediately, without Indonesian approval;

3.      That Australia demand that Indonesia immediately act in
accordance with Article 6 of the Agreement Between the Republic of
Indonesia and the Portugese Republic on the Question of East Timor, to take 
the constitutional steps necessary to terminate its links with East Timor;

4.       That the Australian Government publicly demands the
immediate withdrawal of TNI forces from East Timor and ceases all military
training and military aid to Indonesia until this demand is met;

5.      That the Australian Government provide UN controlled Peace
Keeping Forces and, as a member-state of the UN, demand of the UN that
the Peace Keeping Troops secure the western boarder of East Timor to
prevent Militia or Military incursion into East Timor;

6.      That the Australian Government, as a member-state of the
United Nations, demand that a code of conduct be established and
enforced in consultation with CNRT to ensure that the societal and
environmental impact of any Peace Keeping forces are minimised;

7.      That the Australian Government uses all diplomatic avenues
available to demand a 200km Indonesian Military Exclusion Zone be
established around the coast of the island of East and West Timor. Within
this exclusion zone, no Indonesian military vessels, submarines and 
aircraft
(which are reported to be currently involved in supplying arms and 
personnel
to the militias) should be permitted;

8.      That the Australian Government apply diplomatic pressure to
prevent the establishment of a Military Operational Area (DOM) within
West Timor by TNI;

9.      That in its capacity as a member-state of the UN, the Australian
Government lobby for an investigation of 'undercover' or 'plain-clothes' 
TNI
operations, and insists upon the withdrawal of these forces;

10.     That the Australian Government give a commitment to provide
humanitarian aid and protection to Internally Displaced Persons, that the
Australian Consul not turn away East Timorese seeking refuge and
protection within the Dili Consulate;

11.     That Australia use its position as a member-state of the
United Nations to pressure for the establishment of an International
Tribunal for the Prosecution of Persons Responsible for Serious Violations
of International Humanitarian Law in East Timor During the
Occupation by Indonesia.


DEMANDS OF THE INDONESIAN GOVERNMENT

1.      That Indonesia immediately act in accordance with Article 6
of the Agreement Between the Republic of Indonesia and the Portugese
Republic on the Question of East Timor, to take the constitutional steps
necessary to terminate its links with East Timor;

2.      That Indonesia immediately withdraw TNI forces from East
Timor and cease to provide support to, or direct, militia;

3.      That Indonesia dismantle all Military Operational Areas
(DOMs) within West Timor;

4.      That Indonesia allow the free return of all East Timorese to
East Timor from West Timor or other areas to which they have been
Forcibly removed.


DEMANDS OF THE UNITED NATIONS

1.      That as Article 3 of the Agreement Between the Republic of
Indonesia and the Portugese Republic on the Question of East Timor, which
gave Indonesia responsibility for peace and security in East Timor, has 
been
breached, the Secutity Council should immediately send
peacekeeping forces to East Timor, without Indonesian approval;

2.      That the UN demand that Indonesia immediately act in
accordance with Article 6 of the Agreement Between the Republic of 
Indonesia
and The Portugese Republic on the Question of East Timor, to take the
Constitutional steps necessary to terminate its links with East Timor;

3.      That the UN demand the immediate withdrawal of TNI forces
from East Timor, and takes whatever measures necessary to ensure that TNI
forces are removed from East Timor;

4.      That the Peace Keeping Troops secure the western boarder of
East Timor to prevent Militia or Military incursion into East Timor;

5.      That the UN establish mechanisms for an investigation of
'undercover' or 'plain-clothes' TNI operations, and insists upon
the withdrawal of these forces;

6.      That a code of conduct be established and enforced in
consultation with CNRT to ensure that the societal and environmental impact 
of any Peace Keeping forces are minimised;

7.      That a 200km Indonesian Military Exclusion Zone be
