Subject: Information on the human rights biolations of UNHCR (New Delhi India)

Dear Friends,

All of you are not only aware of the Burmese refugees who have been
recognized  and protected by UNHCR, New Delhi, but also giving sympathy and
supports on a purely humanitarian basis to those refugees who came away to
India and struggling for human rights for their future life.

UNHCR's mandate to protect and assist refugees extends only to those living
in Delhi. The people of The Burmese refugees are living in Mizoram, Manipur,
Arunachal pradesh State of India (N-E), Moreover, these people have been
struggling for their livelihood very hard and harassed by the local
authorities by any means. But UNHCR could not approach to investigate those
issues. No body or no organizations were concerned about for that. This
definitely has created quite a lot of uncertainty and confusion in their
minds.

Mr. Kyaw Kyaw, the holder of UNHCR (India) refugees certificate Bu-148
issued in Oct. 1993. In 1995, thousands of Arakanese refugees from Arakan
State of Burma fled to Mizoram state of India due to extra-judicial killing
of the villagers by the Burmese Army. Therefore, he as a student leader,
President of All Arakan students and Youths Congress (AASYC) felt concerned
for those refugees' plights and went to Mizoram in Oct. 1995 to collect the
information and study for the situations of the refugees. Then, he intended
to come back Delhi in time of S.A (Subsistence Allowance) collecting period.
However, he could not come in time because he had spent all the money for
some refugees who were poor and needy. At the same time he could not able to
pay for his journey to Delhi. So his trip lasted long for six months and he
was absent to collect S.A three times and then UNHCR office has cut off his
S.A. When he had submitted appeals in request to get back his S.A so that he
can continue his study for his settlement by himself, Social Officers of
UNHCR office, New Delhi has inhumanely denied his appeals repeatedly for
four years long. If he, as a political refugee, should not do any things for
the neglected refugees who or which organizations are responsible for that
case? Is it against international laws or civil or political rights? Should
a refugee do nothing for his country or his community while they are
suffering under the military regime in Burma? Now, his life becomes worse
and havoc physically and mentally. He could do nothing preparation for his
resettlement due to unkind and inhumane gesture of UNHCR and uncertainty
lays on his future life.

I am sure that UNHCR is concerned for the Arakanese refugees who are still
sheltering in India and Bangladesh border. Even if UNHCR could not help all
the Arakanese refugees, it should not stop S.A for those who are working for
them. Because the Burmese military government's bench-mark policies are
brutal, dictatorial, genocide, illegal detention, human rights violations
and so on. Hence if you are supporting for those who came away to India and
seeking for political asylum, please do come out and support us . As you are
a part of the friends of Burma, please recommend for those who work for
their country or community. Then, no one can stop our struggle for democracy
and federalism in Burma.
